OFFICIAL RULES

NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCE OF WINNING.

CAMPAIGN DESCRIPTION: The Find Your Maxx Contest (the "Campaign") begins on August 4, 2022 at 9:00:00 a.m. Eastern Time ("ET") and ends on August 26, 2022 at 11:59:59 p.m. ET (the "Campaign Period"). The Campaign gives people the opportunity to submit a statement about what their “Maxx” is for judging to select twenty-five (25) semi-finalists. Ten (10) finalists will be selected for interviews to select one (1) grand prize winner who will receive one (1) payment of $50,000.00, one (1) payment of $20,000.00 to help offset tax liability of the $50,000 prize amount, and mentoring from a Sponsor-selected celebrity mentor; and five (5) runner-up winners who will each receive a payment of $10,000.00 and mentoring sessions with a coach, as further detailed below. An entrant’s “Maxx” is an actionable and compelling personal goal that is achievable with the support offered though the prize. By participating in the Campaign, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of The TJX Companies, Inc., 770 Cochituate Road, Framingham, MA 01701 ("Sponsor"), which shall be final and binding in all respects.

ELIGIBILITY: Only legal residents of the 50 United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry, and who identify as women, are eligible to enter. Officers, directors and employees of Sponsor and its parent, subsidiaries, affiliates, sales representatives, advertising and promotion agencies (all such individuals and entities collectively referred to herein as the "Campaign Entities"), and each of their immediate family members and/or those residing in the same household of each are NOT eligible to enter the Campaign or win a prize. This Campaign is void where prohibited.

HOW TO ENTER: To enter, during the Campaign Period, visit findyourmaxx.com and fill out the entry form including all required information as well as a video submission responding to the following questions: 1) “In moments when you’ve felt like the most authentic version of yourself, what were you doing?; 2) What is holding you back from being that version of yourself every day?; 3) If you get the opportunity to “Find Your Maxx” what do you see for yourself in the future?; and 4) What do you hope to gain from having a celebrity mentor as your mentor? (the ”Submission”). Submissions should be as specific as possible, may not be political in nature, and may not exceed 2 minutes (120 seconds) and 100 MB of file size. Submissions should be in one of the following file formats: MPEG, MP4, MOV, AVI, FLV or M4V. Finalists must also provide the names of all of their social media handles and make all of their social media accounts public for review as part of the vetting process. Limit one (1) entry per person.

The Submission must meet the following ”Submission Requirements”: (i) the Submission must be the submitting entrant’s original, previously unpublished work and not include any material owned or controlled by third parties (including without limitation, third party copyrighted material); (ii) the entrant must provide upon request all appropriate clearances, permissions, and releases for the Submission (in the event an entrant cannot provide all required releases, Sponsor reserves the right, in Sponsor’s sole discretion, to disqualify the applicable Submission, or seek to secure the releases and clearances for Sponsor’s benefit, or allow the applicable Submission to remain in the Campaign); and (iii) the Submission must not include any content that is obscene, pornographic, libelous, or otherwise objectionable. Any Submission that, in Sponsor's good faith judgment, violates the Submission Requirements will be disqualified. Submissions must be received during the Campaign Period. No substitutions of new versions of Submissions will be accepted under any circumstances once the original Submission is submitted for consideration. Any Submission that is considered by Sponsor in its sole and absolute discretion to be obscene, pornographic, libelous, hate speech, or otherwise objectionable, in whole or in part, will be disqualified and will not be eligible for entry. Entrant should be the only person who appears in the Submission. If anyone else appears in the Submission, the entrant must obtain written permission from that person or those people to include them in the Submission (and they must be eighteen (18) years old or older), and if Sponsor asks to see the written permissions, the entrant must provide them upon request (in the event an entrant cannot provide permissions that are satisfactory to Sponsor, in its sole and absolute discretion, Sponsor reserves the right to disqualify the applicable entry, or seek to secure the releases and clearances for Sponsor’s own benefit, or otherwise allow the applicable entry to remain in the Campaign).

GENERAL CONDITIONS OF ENTRY: Entry must be made during the Campaign Period to be entered into the Campaign. Sponsor is the official timekeeper for the Campaign. All entry information and materials become the property of Sponsor and will not be acknowledged or returned. Proof of providing information to Sponsor is not considered proof of delivery to or receipt by Sponsor of such entry. Except as otherwise contemplated in these Official Rules, and to the extent entrants may otherwise elect at the time of entry, personal information collected in connection with the Campaign will be used in accordance with Sponsor’s online privacy policy, located at https://tjmaxx.tjx.com/store/jump/topic/find-help/legal/2400080#privacypolicy. Any communication or information transmitted to Sponsor by e-mail or otherwise is and will be treated as non-confidential and non-proprietary.

Entry must be made by the entrant. Sponsor shall have no liability for any entry that is lost, intercepted or not received by the Sponsor. Tampering with the entry process or the operation of the Campaign is prohibited and any entries deemed by Sponsor, in its sole discretion, to have been submitted in this manner will be void. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible. The Campaign Entities shall not be responsible for incorrect or inaccurate entry information whether caused by human or by any of the equipment or programming associated with or utilized in the Campaign or by any technical or human error which may occur in the processing of the entries in the Campaign. The Campaign Entities assume no responsibility or liability for any error, omission, interruption, deletion, theft or destruction or unauthorized access to or alteration of entries.

REPRESENTATIONS AND WARRANTIES; INDEMNIFICATION: Each entrant represents and warrants as follows: (i) the Submission is the entrant’s own original, previously unpublished, and previously unproduced work; (ii) the Submission is wholly original with entrant, and as of the date of submission, is not the subject of any actual or threatened litigation or claim; (iii) the Submission does not and will not violate or infringe upon the intellectual property rights or other rights of any third party; and (iv) the Submission does not and will not violate any applicable laws, and is not and will not be defamatory or libelous. Each entrant hereby agrees to indemnify and hold the Campaign Entities harmless from and against any and all third-party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of any breach or alleged breach of any of the warranties, representations or agreements of entrant hereunder.

ENTRANT'S GRANT OF RIGHTS: Each entrant hereby irrevocably and exclusively assigns to The TJX Companies, Inc. (“TJX”) all of his/her ownership, right, title, and interest in and to the Submission, including, without limitation: (a) all copyrights, trademarks, and other intellectual property rights, and all other rights that may hereafter be vested arising under United States or any other law, together with all national, foreign, state, and common law registrations, applications for registration, and renewals and extensions thereof relating to the Submission; (b) all goodwill associated with the Submission; and (c) all benefits, privileges, causes of action, and remedies relating to any of the foregoing, whether before or hereafter accrued (including, without limitation, the exclusive rights to apply for such registrations, renewals, and/or extensions, to sue for all past infringements or violations of any of the foregoing, and to settle and retain proceeds from any such actions).

To the extent the paragraph above does not provide TJX with full ownership, right, title, and interest in and to the Submission, entrant hereby grants to TJX an exclusive, worldwide, perpetual, irrevocable, fully paid, royalty free, transferable, sub-licensable, license to reproduce, modify, create derivative works from, distribute, publicly perform, publicly display, and use the Submission, with the right to sublicense each and every such right. Each entrant irrevocably waives any and all so-called moral rights they may have therein. Sponsor shall have the right to freely assign its rights hereunder, in whole or in part, to any person or entity. Sponsor shall retain the rights granted in each Submission even if the Submission is disqualified or fails to meet the Submission Requirements.

WINNER SELECTION: Throughout the Campaign Period, Sponsor (or its designee) will select the winners as indicated below based on the following judging criteria (”Criteria”) and subject to satisfactory completion of social media vetting for all semi-finalists:

  • Intriguing story (60%)
    • Can define what finding your “Maxx” looks like
    • Know what is standing in your way
    • Your Maxx is actionable, within reach, and compelling
    • Maxx is not political in nature
  • Excellent communication skills (40%)
    • Confident
    • Open
    • Social media savvy

On or about the week of September 5, 2022, Sponsor (or its designee) will select twenty-five (25) semi-finalists applying the Criteria. On or about the week of September 12, 2022 Sponsor or its designee will select ten (10) finalists from the semi-finalists applying the Criteria. The finalists will then be interviewed by Sponsor in order to determine one (1) grand prize winner and five (5) runner-up winners. The interview process will be in Sponsor’s sole discretion and will be on date and time determined by Sponsor. Finalists must be available for the interview in order to be considered for a prize. Sponsor has the right to film the interview, and all footage from the interview will be owned by Sponsor who has the right to use or not use such footage in its sole discretion. The final selection will take place on or about the week of October 3, 2022. The Criteria will be applied in the sole discretion of Sponsor and the individual judges. By entering the Campaign, entrants acknowledge that such evaluations may differ from person to person and agree to be bound by and not challenge the final decisions of Sponsor and the individual judges. All finalists will be required to complete additional screening by Sponsor (or its designee), including, without limitation, a criminal background check, social media and publicity review, and other screening in Sponsor’s sole discretion in order to be finally declared a winner and receive the prize. In addition, at the discretion of the Sponsor, potential winners may be disqualified: (a) if entrant has been convicted of a misdemeanor within the past seven (7) years or a felony at any time in the past; (b) if Sponsor determines, in its sole discretion, that awarding the prize to such entrant may reflect unfavorably on the Campaign or Sponsor as determined by Sponsor in its sole discretion (including, but not limited to certain misdemeanor convictions more than seven (7) years old and crimes for which entrant was charged but not convicted); (c) if the entrant is not eligible to receive the prize based on the eligibility requirements set forth in these Official Rules; (d) if Sponsor determines that the entrant failed to comply with these Official Rules in any way; or (e) if the entrant refuses to or cannot accept the prize for any reason. Potential winner’s social media profile must be in keeping with the Sponsor’s image or they may be disqualified, in Sponsor’s sole discretion. In the event a winning entry is discovered to be invalid for any reason whatsoever or the person who submitted the winning entry fails to comply with these Official Rules prior to delivery of the prize, the prize may be forfeited and may be awarded to an alternate winner.

FINALIST NOTIFICATION: Sponsor will attempt to notify potential finalists using the contact information provided on the entry form. The potential finalists will be required to execute an agreement with Sponsor detailing the winner’s obligations, compliance with the official rules, and other terms of the prize, a Liability Release, and (where imposing such condition is legal) a Publicity Release (collectively, "Finalist Documents"). If any potential finalist fails or refuses to sign and return all Finalist Documents within forty-eight (48) hours of notification, the finalist may be disqualified and an alternate finalist may be selected. Sponsor shall have no liability for any notification that is lost, intercepted or not received by a potential finalist for any reason. If, despite reasonable efforts, a potential finalist does not respond within forty-eight (48) hours of the first notification attempt, or if a notification is returned as unclaimed or undeliverable to such potential finalist, such potential finalist will forfeit their standing as a finalist and an alternate finalist may be determined from among the semi-finalists. If any potential finalist is found to be ineligible, or if the entrant has not complied with these Official Rules or declines the applicable prize for any reason prior to award, such potential finalist will be disqualified and an alternate finalist may be determined. Sponsor may successively attempt to contact up to two (2) potential finalists in accordance with such procedure, and if there is still no confirmed finalist after such attempts have been made, if any, less than the stated number of finalists may be determined.

PRIZE AND APPROXIMATE RETAIL VALUES (“ARV”): Five (5) runner-up winners will receive a $10,000.00 check made payable to the runner-up winner and a minimum of one (1) mentoring session of at least thirty (30) minutes by telephone or video conference with a coaching professional to be selected by Sponsor in its sole discretion. (ARV: approximately $300 each). One (1) grand prize winner will receive a cash prize of $50,000.00 made payable in installments as described further below, plus an additional payment in the amount of $20,000.00 in order to help offset the amount of taxes due on the prize award. Additionally, the grand prize winner will receive at a minimum four (4) mentoring sessions of at least thirty (30) minutes by telephone or video conference with a celebrity mentor to be selected by Sponsor in its sole discretion. (ARV: The mentoring sessions prize is a one-of-a-kind prize that does not have an actual retail value). The grand prize payments will be made in three (3) installments paid every other month during the six (6) month period following the winner signing and returning the Prize Claim Documents (defined above). All details, including times and dates of the mentorship (and exact mentors) are determined in Sponsor’s sole discretion.

GENERAL PRIZE CONDITIONS: The prize is not an offer of employment and the winner is not an employee of Sponsor nor will the winner receive any additional benefits other than the prize detailed above. The winners agree that the prize money must be used to accomplish the goal stated as the winner’s “Maxx” and for no other purpose. The grand prize winner will be required to perform certain obligations as a part of receiving their prize such as posting about the experience on social media, as specified by Sponsor. In the event the prize winner engages in behavior that, as determined by Sponsor in its sole discretion, is obnoxious or threatening, illegal, that is intended to annoy, abuse, threaten or harass any other person, or that could harm Sponsor’s brand or goodwill in any way as determined by Sponsor in its sole discretion, Sponsor reserves the right to terminate the prize early, in whole or in part, with no further compensation No substitution of prizes will be allowed, except Sponsor reserves the right in its sole discretion to substitute prizes of equal or greater retail value if any prize listed is unavailable, in whole or in part, for any reason. Prizes will be awarded only if the potential prize winner fully complies with these Official Rules. All portions of the prize(s) are non-assignable and non-transferable. Any prizes pictured in point-of-sale, online, television and print advertising, promotional packaging, and other Campaign materials are for illustrative purposes only. All details and other restrictions of the prize(s) not specified in these Official Rules will be determined by Sponsor in its sole discretion.

THE PRIZE WINNER SHALL BE SOLELY RESPONSIBLE FOR ALL FEDERAL, STATE AND/OR LOCAL TAXES, AND THE REPORTING CONSEQUENCES THEREOF, AND FOR ANY OTHER FEES OR COSTS ASSOCIATED WITH THE APPLICABLE PRIZE. THE PRIZE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND SPONSOR HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.

DATES & DEADLINES/ANTICIPATED NUMBER OF ENTRANTS: Because of the unique nature and scope of the Campaign, Sponsor reserves the right, in addition to those other rights reserved herein, to modify any date(s) or deadline(s) set forth in these Official Rules or otherwise governing the Campaign. Sponsor cannot accurately predict the number of entrants who will participate in the Campaign.

PUBLICITY RELEASE: By participating in the Campaign, in addition to any other grants which may be granted in any other agreement entered into between Sponsor and any entrant in or winner of the Campaign, each entrant irrevocably grants the Campaign Entities and their respective successors, assigns and licensees, the right to use such entrant’s name, likeness, biographical information, and statements in any and all media for any purpose, including without limitation, advertising and promotional purposes as well as in, on or in connection with the Sponsor’s website or the Campaign or other promotions, and hereby release the Campaign Entities from any liability with respect thereto.

NATURE OF RELATIONSHIP/WAIVER OF EQUITABLE RELIEF: Each entrant hereby acknowledges and agrees that the relationship between the entrant and the Campaign Entities is not a confidential, fiduciary, or other special relationship, and that the entrant’s decision to provide the entrant’s Submission to Sponsor for purposes of the Campaign does not place the Campaign Entities in a position that is any different from the position held by members of the general public with regard to elements of the entrant’s Submission. Each entrant understands and acknowledges that the Campaign Entities have wide access to ideas, stories, photographs, designs, and other literary materials, and that new ideas are constantly being submitted to it or being developed by their own employees. Each entrant also acknowledges that many ideas or artwork may be competitive with, similar or identical to the Submission and/or each other in theme, idea, format or other respects. Each entrant acknowledges and agrees that such entrant will not be entitled to any compensation as a result of any Campaign Entity’s use of any such similar or identical material. Each entrant acknowledges and agrees that the Campaign Entities do not now and shall not have in the future any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of the copyright in and to the Submission.

NO OBLIGATION TO USE: Sponsor shall have no obligation (express or implied) to use any Submission or any materials or content created by the entrant or any winner (the ”Materials”), or to otherwise exploit any Submission or Materials or, if commenced, to continue the distribution or exploitation thereof, and Sponsor may at any time abandon the use of the Submission or Materials for any reason, with or without legal justification or excuse, and contestants shall not be entitled to any damages or other relief by reason thereof.

GENERAL LIABILITY RELEASE/FORCE MAJEURE: Entrants agree that the Campaign Entities (A) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Campaign or any Campaign-related activity, or from entrants’ acceptance, receipt, possession and/or use or misuse of any prize, and (B) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose. Sponsor assumes no responsibility for any damage to an entrant’s, or any other person’s, computer system which is occasioned by accessing any website or otherwise participating in the Campaign, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or postage-due prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Campaign, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Campaign, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. No mechanically reproduced, incomplete, forged, software-generated or other automated multiple entries will be accepted. Sponsor reserves the right to modify, extend, suspend, or terminate the Campaign if it determines, in its sole discretion, that the Campaign is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Campaign as contemplated herein. In the event an insufficient number of eligible entries are received and/or Sponsor is prevented from awarding prizes or continuing with the Campaign as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other similar or dissimilar cause not reasonably within Sponsor’s control (each a "Force Majeure" event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, extend or terminate the Campaign. If the Campaign is terminated before the designated end date, Sponsor will (if possible) determine the winners based on the Criteria outlined above from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Inclusion in such judging shall be each entrant’s sole and exclusive remedy under such circumstances. Only the type and quantity of prizes described in these Official Rules will be awarded. These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of Sponsor. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

GOVERNING LAW/JURISDICTION: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE CAMPAIGN SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE COMMONWEALTH OF MASSACHUSETTS WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS. FOR THE PURPOSES OF ANY DISPUTES HEREUNDER, BY ENTERING THIS CAMPAIGN, EACH ENTRANT AGREES THAT ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR IN ANY WAY RELATED TO THIS CAMPAIGN SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION AND CONSENTS TO THE EXCLUSIVE JURISDICTION AND VENUE OF THE APPROPRIATE STATE OR FEDERAL COURT SITUATED IN THE COMMONWEALTH OF MASSACHUSETTS.

ARBITRATION PROVISION: By participating in this Campaign, entrant agrees that any and all controversies, claims, counterclaims or other disputes entrant may have with, or claims entrant may have against the Promotion Entities relating to, arising out of or connected in any way with (a) the Campaign, (b) the awarding or redemption of any prize, and/or (c) the determination of the scope or applicability of this agreement to arbitrate (a ”Claim”), will be resolved exclusively by final and binding arbitration in accordance with the Rules of the American Arbitration Association (”AAA Rules”). The arbitration will be heard and determined by a single arbitrator. The arbitrator's decision in any such arbitration will be final and binding upon the parties and may be enforced in any court of competent jurisdiction. The parties agree that the arbitration proceedings will be kept confidential and that the existence of the proceeding and any element of it will not be disclosed beyond the arbitration proceedings, except as may lawfully be required in judicial proceedings relating to the arbitration, by applicable disclosure rules and regulations of securities regulatory authorities or other governmental agencies, or as specifically permitted by state law. The Federal Arbitration Act and federal arbitration law apply to this agreement. However, the Arbitrator, and not any federal, state, or local court or agency, shall have the exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of these Official Rules including, but not limited to, a claim that all or any part of these Official Rules is void or voidable.

If entrant demonstrates that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of the administrative costs and arbitrator’s fees required for the arbitration as the arbitrator deems necessary to prevent the cost of the arbitration from being prohibitive. In the final award, the arbitrator may apportion the costs of arbitration and the compensation of the arbitrator among the parties in such amounts as the arbitrator deems appropriate.

This arbitration agreement does not preclude entrant from seeking action by federal, state, or local government agencies. Entrant and Sponsor also have the right to bring qualifying claims in small claims court. In addition, entrant and Sponsor retain the right to apply to any court of competent jurisdiction for provisional relief, including pre-arbitral attachments or preliminary injunctions, and any such request shall not be deemed incompatible with these Official Rules, nor a waiver of the right to have disputes submitted to arbitration as provided in these Official Rules.

Neither entrant nor Sponsor may act as a class representative, nor participate as a member of a class of claimants, with respect to any Claim. Claims may not be arbitrated on a class or representative basis. The arbitrator can decide only Entrant and/or Sponsor’s individual Claims. The arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated. If for any reason a claim proceeds in court rather than in arbitration we each waive any right to a jury trial. Notwithstanding anything to the contrary herein, the arbitrator may award in the arbitration the same damages or other relief available under applicable law, including injunctive and declaratory relief (which may include public injunctive relief), as if the action were brought in court on an individual basis.

THIS SECTION LIMITS CERTAIN RIGHTS, INCLUDING THE RIGHT TO MAINTAIN A COURT ACTION, THE RIGHT TO A JURY TRIAL, THE RIGHT TO PARTICIPATE IN ANY FORM OF CLASS OR REPRESENTATIVE CLAIM, THE RIGHT TO ENGAGE IN DISCOVERY EXCEPT AS PROVIDED IN AAA RULES, AND THE RIGHT TO CERTAIN REMEDIES AND FORMS OF RELIEF. OTHER RIGHTS THAT ENTRANT OR SPONSOR WOULD HAVE IN COURT ALSO MAY NOT BE AVAILABLE IN ARBITRATION. If any provision of this Section is found to be invalid or unenforceable, then that specific provision shall be of no force and effect and shall be severed, but the remainder of this Section will continue in full force and effect. No waiver of any provision of this Section of these Official Rules will be effective or enforceable unless recorded in a writing signed by the party waiving such a right or requirement. Such a waiver shall not waive or affect any other portion of these Official Rules. This Section of these Official Rules will survive the termination of your relationship with Sponsor.
